CHAPTER TWO

VESSEL SERVICES

2.1 PILOTING, TUGBOAT, BERTHING — DEBERTHING, ANCHORING SERVICES FEES

(Tariff No. 1)

2.1.1 CONTENT OF TARIFF:

This tariff includes; all provided services during vessel's berthing and leaving into/from Free Zone pier, roping the vessel to the buoy or breakwaters, anchoring, stern docking, leaving the berthing areas, shifting the vessel for any reason.

2.1.2 DEFINITION OF SERVICE:

A) Piloting; means pilot aiding service, transport boat service in its responsibility area.

B) Tugboat service; means, in its responsibility area, provided tugboat and marine boat services.

C) Berthing service; means, provided roping and untie services in berthing areas.

D) Anchoring service; means the services for vessel anchoring in pre-defined areas.

2.1.3 BASIC FEES FOR PILOTAGE (GUIDING):

2.1.3.1. Piloting service is optional for 0-500 GRT vessels.

2.1.3.2. 30 % additional fee will be charged for Tankers, explosive or flammable loaded vessels.

2.1.3.3. Above fees will be increased by 50 % on Saturday, Sunday and Official Holidays.

2.1.3.4. For refueling ships or the ships to be repaired in shipyard, 50 % discount will be applied. .

2.1.3.5. Inside port shifting pilot fees will be discounted by 50 %.

2.1.3.6. These fees are for single entrance in USD.

2.1.3.7. Gross Ton values on the table will be calculated in DWT for battleships.

2.1.4.1. Tug boat service is optional for 0-1000 GRT ships. In case there is a demand, above fees will be charged. 2.1.4.2. For other vessels, up to 3000 GRT, tug boat service fee is fixed at 283 USD, for additional per 1000 GRT, 53 USD will be charged. 2.1.4.3. 30 % additional fee will be charged for Tankers, explosive or flammable loaded vessels. 2.1.4.4. Above fees will be increased by 50 % on Saturday, Sunday and Official Holidays. 2.1.4.5. The ships with bow and stern-thruster usages single tug boat and 50 % discount is applied. If the second tug boat is required full service fee will be paid.
2.1.4.6. If the ship has only bow thruster, one tug boat is used. If required, second tug boat can be used. 2.1.4.7. For refueling ships or the ships to be repaired in shipyard, 50 % discount will be applied. 2.1.4.8. Inside port Shifting tug boat fees will be discounted by 50 %. 2.1.4.9. These fees are for single entrance in USD. 2.1.4.10. Gross Ton values on the table will be calculated in DWT for battleships.

2.1.5 BASIC FEES FOR BERTHING:

2.1.5.1. 30 % additional fee is charged for Tankers, explosive or flammable loaded vessels. 2.1.5.2. Above fees will be increased by 50 % on Saturday, Sunday and Official Holidays. 2.1.5.3. Gross Ton values on the table will be calculated in DWT for battleships.

2.1.6 BASIC FEES FOR ANCHORAGE:

Anchoring in the port, lifting anchor and showing location for anchorage services, including pilotage service, for 1000 GRT and for each service of pilotage 40 US$ is charged.

2.1.7. APPLICATION TERMS:

A) Basic Fee Extent; Piloting and Tug Boat fees include; all provided services during docking and leaving of the vessels into/from Free Zone Port, roping the vessels to the buoy or breakwaters, anchoring , stern docking, leaving the berthing areas, shifting the vessels for any reason. However, self-shifting, permitted by MESBAŞ, alongside the same quay and necessary shifting by MESBAŞ are free. Basic Tug Boat Fees on the table; will be applied for Free Zone Port Services, defined in Port Regulations and Instructions. Tug Boat services out of zone port will be charged raised by 100 %.

B) Starting and Ending of services; Piloting and Tug Boat Services; starts when pilot captain is on board and the Tug Boat comes alongside and ends when they leave.

C) Obligation to have Pilot and Tug Boat; Port Charter, Governance and Regulation for indicated vessels with GRT and Displacement Tonnage, entry and exit from the port, leaving and shifting inside the port for any reason, they are obligated to receive pilot and tug boat services. Vessels that do not co-operate with this obligation are subject to 100% raise of the basic fees.
However, in case of bad weather condition the vessel departs from the quay by itself by receiving letter of approval from the Port Directorate, no additional fee will be charged.

D) Waiting Fee; If the vessel can not dock to the indicated quay in time , can not be roped to the indicated buoys in time or depart from berthing areas in time and for that reason if the pilot, tug boat and their crew, on request of Captain or Agency, because of the reasons on Article (1.5.9) of General Terms of Tariff; 1) in case of continuation of wait and at the end of wait delay of service, 2) in case of continuation of wait and at the end of wait not receiving any service, 3) in case of vehicles and crew appointed to the service arrives and is subject to wait and returns without providing any

service, Fee will be charged in accordance with the tariff of Mersin International Port Operator Inc. Directorate

E) Tug Boat Service for Defected Vessels; Vessels that can not operate or move by their own or can not maneuver due to the failure of rudder, the tugboat service is received by 100% with additional fees. (Except for vessel rescue services.)

2.2 HARBOURING SERVICES (OCCUPYING AND BREACH OF CLOSE) TARIFF

(Tariff No. 2)

2.2.1 EXTENT OF TARIFF:

This tariff includes harboring services for the ships which docks, stern docks, approaching to the quays or using MESBAŞ's berthing areas.

2.2.2 DEFINITION OF SERVICES:

A) Occupying;

During indicated service period, harbouring of the ships,

B) Breach of Close;

Breach of closed areas after the end of defined harbouring service or without the permission of MESBAŞ is considered as a breach of close.

2.2.3 BASIC FEES:

2.2.3.1. For each harbouring day 0,010 USD per gross ton (GRT).

2.2.3.2. For Cabotage Liners, for each harbouring day 0,005 USD per gross ton (GRT).

2.2.4 APPLICATION TERMS:

A) Basics of Harbouring Services;

1) Extent of Fees:

The Fees include, all provided services during harbouring of the ships in MESBAŞ quays and berthing areas. -Docking day and departure day will be regarded as full day. -In case of shifting, if there is a difference, higher harbouring fee will be charged for full harbouring period. -In case of additional sea-vehicle usage due to easy service, insufficient deepness or any other reason and if this demand is accepted by MESBAŞ, harbouring service fee will be charged raised by 100% .( sea-vehicle is free) -If the ship leaves the berthing area but stays in port boundary, and comes back within 7 days , any fee will not be charged. -If a ship comes alongside other ship in berthing area, harbouring fee will be calculated according to that berthing area tariff.

2) Other Facilities, regarded as harbour:The permanent stationary and floating facilities which gives harbouring service will be regarded as harbouring area.

B) Basics for Breach of Close;

1) Extent of Fees:

Facilities indicated for vessels harbouring within the extent;

-When they don't go or shift or leave to/from the indicated berthing area within 3 hours although they were given a relevant notice by MESBAŞ,

-Occupies without MESBAŞ's permission,

-Occupies and does not demand marine boat (but if breach of close depends on shifting operation and shifting is not performed by MESBAŞ, breach of close fee will not be charged).

- In case of the ship executes loading-unloading operation by its own vehicles and facilities, if loading -unloading operation doesn't start within 4 hours, or operation postponed or paused or loads are less than indicated amount, breach fee will be charged per hour or its fractions.

2) Leaving from Berthing Area due to Bad Weather Conditions:

If departure permission is not given by Port Directorate due to bad weather, breaching fee will not be charged.

3) Piloting and Tug boating Service Cannot be Given:

In case of Piloting and Tug Boat services is not provided by MESBAŞ in due, breaching fee will be charged.

-don't go or shift or leave to/from the indicated berthing area within 3 hours although they give the relevant notice by MESBAŞ -occupies without permission of MEBSAŞ , -occupies and also demand marine boat (but if breach of close depends on shifting operation and shifting is not performed by MESBAŞ, breach of close fee will not be charged) -In case of the ship executes loading-unloading operation by its own vehicles and facilities, if loading -unloading operation doesn't start within 4 hours, or operation postponed or paused or loads are less than indicated amount, breach fee will be charged per hour or its fractions. 2) Leaving from berthing area due to bad weather conditions: If departure permission is not given by Port Master due to bad weather, breaching fee will not be charged. 3) If Piloting and Tug Boat Services can not be given: In case of Piloting and Tug Boat services is not provided by MESBAŞ in due, breaching fee will be charged.
2.3 FRESH WATER SERVICE TARIFF (Tariff No. 3)

2.3.1 EXTENT of THE SERVICE:This tariff includes fresh water service for the vessels by MESBAŞ inside the Free-Trade Zone Port.

2.3.2 BASIC FEES: BASIC FEES TABLE TON / USD

2.3 FRESH WATER SERVICE TARIFF

(Tariff No. 3)

2.3.1 EXTENT OF SERVICE:

This tariff includes fresh water service for the vessels by MESBAŞ within the Free Zone Port.

2.3.2 BASIC FEES:

2.3.3 APPLICATION TERMS:

A) Extent of Fees Table; Fees on the table; includes, purchasing price of fresh water from local Municipality, fresh water transfer service and vehicle fees, and if used sea-vehicle fee.

B) Determining the fees; all discounts and increases on fresh water prices by local Municipality, can be reflected on the fees by MESBAŞ.

C) Determining the Amount of Water; Transferred fresh water amount will be determined by MESBAŞ. During water transfer, authorized vessel personnel can check the amount, if they don't use their inspection right; later objections will not be considered.

D) Meeting the Demands;

MESBAŞ meets the fresh water demands depending on request order and port capacity. According to capacity and urgency, MESBAŞ is authorized to change the order.

E) Minimum Fee; Fresh water sum can not be less than 5 tons water fee for valve transfer.

F) Refused Water Fee;

If demanded fresh water from sea-vehicle is refused totally or partly;

1) If totally refused, 25% of total sum fee,

2) If partly refused, 25 % of difference (it can not be less than minimum fee)

will be charged additionally.

G) Incomplete Water Transfer;

In case of incomplete water transfer by MESBAŞ, actual transfer sum will be charged and minimum amount will not be considered.

H) Waiting Fee ; During fresh water transfer by sea vehicle, if the coming alongside vehicle and its crew are kept waiting before / after starting water transfer operation for the reasons indicated general terms of the tariff (1.5.9) , 5 USD will be charged per hour and fractions.

İ) Service by tanker truck; In case of tanker truck service with port operator permission by users, 25 % of valve transfer fee will be charged. .

İ) Out of Port Boundary Service; In case of acceptance of such a demand by MEBSAŞ, the fee will be determined by MEBSAŞ.

J) Discount Fees;

Discount by 25 % for Cabotage Liners.

2.4COLLECTION SERVICE OF WASTE FROM VESSELS TARIFF

(Tariff No. 4)

2.4.1 EXTENT OF SERVICE AND EXPLANATION:

Waste collection from vessels and lashed lighter, means collection from the vessels or lighter waste by MESBAŞ vehicles inside the port boundary.

T.R. Ministry of Environment and Forests 26.12.2004 dated 25682 numbered and circulated in the Official Gazette "Regulation of Collecting Refuse form Vessels and Control of Refuse Regulation" is applicable for this tariff.

In addition; 2872 numbered Environment Law; 13.05.2006 dated 26167 numbered, circulated in the Official Gazette and has been under enforce 26.04.2006 dated 5491 numbered "Law for Change in Environment Law" obligations, liabilities concern the parties using this tariff.

* If the given waste's amount is large, than it is completed for the next total number.

Example: 0,2 m3waste is considered as ð1 m3waste.

1,3 m3waste is considered as ð2 m3waste etc.

MATTERS TO CONSIDER ABOUT THE FEE TARIFF'S APPLICATION

1- Tariff table of basic fees for waste collection form vessels 1. Section indicated that (GRT) gross ton and Minimum Wage Fee Charges for Waste/ incase of giving only one section, the indicated Minimum Charge Fee will be collected. Indicated waste types and those going above the stated amounts, for extra waste and its type 2. Section each m3bulk tariff fee is imposed. Fees are collected as Euro (Є).

2- Minimum Charge Fees are collected when the waste collection service is initiated, under no circumstance there can not be any discount to this service.

3- The Minimum Charge Fee tariff can not be applied to yachts, vessels operating in cabotage lane, fishing boats and community service boats, they will be charged for the type of waste and each m3 bulk they will give.

4- Yachts, passenger liners, vessels operating in cabotage lane, fishing boats and community service boats, for each m3 bulk of waste they will transfer, extra fees are subject to 50% discount; Tankers under 150 gross ton in Cabotage lane and other vessels under 400 gross ton, extra fees are subject to 25% discount for each m3bulk of waste they will transfer.

5- Vessel that requests for waste collection from Ports within Our Country will be charged by Minimum Charge Fee, after the fee is collected, for any reason the same vessels requests another collection form a different port(s) within our borders cannot be subject to Minimum Charge Fee, for each m3bulk of waste tariff is imposed.

6- a) Vessels destined to pass through Turkish Straights without halt

requesting waste collection is subject to Minimum Charge Fee

waste collection requests afterwards is subject to

each m3bulk of waste tariff.

b) In case of colleting waste in deep waters, all fees are increased by 40%.

7- a) Vessels that approached to the port or platform/ vessels that cannot

approach to the platform due to technical difficulties and request waste

collection are not subject to deep water waste collection tariff.

b) Boats with private boat documentation, deep water waste collection

tariff can not apply to private yachts.

8- Operation hours are in between 0800 - 1700.

9- Besides the operation hours, weekend, and during holidays excluding the set fees, tariffs are charged 40% more.

10- In fault of the vessels during waste transfer, for every hour that transfer is not received an additional fee of 30 Є will be charged.

11- Additional fees are charged at maximum rate for waste's each

m3bulk, transportation distance, removal cost, port's infrastructure

taking matters such as these into consideration the maximum

amount of discount can be applied is 50%.

2.4.3 APPLICATION TERMS:

A) Extent of Basic Fees;

The fees on the table include all vehicle, mobile tankers and crew expense used by MESBAŞ to collect solid and liquid waste from vessels and lighters.

B) Collection of Service Fees;

Service fee is collected in advance from the vessel captain or from its agent before starting the service.

C) Order in Completion of Service;

MESBAŞ, deals with waste control and transfer by the order it was received in and by the ports capacity.

D) Enforced Obligations of the Vessels;

Vessels to transfer their waster:

-Solid wastes must be in, sealed barrels, in plastic or similar bags or cups in gangway or head of quay and with time appointed with MESBAŞ,

-Liquid wastes, vessels must prepare the bilge valve to start the transfer to the mobile tanker immediately. Vessels that do not follow this procedure will receive services at a convenient time from MESBAŞ.

2.4.4 IMPROPER BEHAVIORS AND PENALTY PROVISIONS:

For vessels that do not co-operate with associated Law and to this Tariff or releasing their waste to the sea and causing water pollution 07.06.2006 dated 26191 numbered and In Accordance to 2872 Numbered Environment Law and Penalty Fees are enforced in accordance to (2006/10) numbered Notification.
